How do you know if you're a W2 employee or a 1099 independent contractor?
Classifying workers as W2 employees requires that the hiring company withhold federal, state, and local income taxes, pay half of the tax mandated under the Federal Insurance Contributions Act (for Social Security and Medicare), pay the full tax required under the Federal Unemployment Tax Act and any State Unemployment tax.
The only tax form independent contractors need to complete is a 1099-MISC at the end of the tax year.
The IRS has a stringent set of rules regarding 1099 status, and the majority of H2 Agency employees are paid as W2 employees.
A list of 20 factors compiled by the IRS has been used in court decisions. The determination is based on common law rules.
An employer generally has the right to control how a W2 employee performs the service. A 1099 worker determines for him/herself how the work will be performed.
Facts that provide evidence of the degree of control and if someone TRULY is a 1099 falls into three categories: behavior control, financial control and the type of relationship.
